Terms of Service
Acceptance of these Terms
By using the Service, the user is deemed to have given valid and irrevocable consent to these Terms. Users who do not consent to these Terms may not use the Service.
User Registration
Persons who wish to use the Service may register by agreeing to these Terms, applying for registration in the manner specified by the Company, and obtaining the Company's approval.
Refusal of Registration
The Company may refuse to approve an application for registration if it determines that any of the following applies. The Company is under no obligation to disclose the reason for refusal.
- The applicant has submitted false information
- The application is from a person who has previously violated these Terms
- Any other case in which the Company determines that registration is not appropriate
Use by Minors
If the user is a minor, the user must use the Service with the consent of a legal representative. The smartphone or other devices required to use the Service must also be used with the consent of a legal representative.
If a user who began using the Service without the consent of a legal representative reaches the age of majority, the user is deemed to have ratified all acts of use performed while a minor.
Management of Login Information
The user shall manage the login information for the Service appropriately at the user's own responsibility. Under no circumstances may the user transfer, lend, or share login information with a third party. The Company is not liable for any damage arising from the use of login information by a third party, except in cases of willful misconduct or gross negligence on the part of the Company.
Use of Content
The Company grants the user a license to privately use the text, images, videos, audio, music, software, programs, code, and other content provided by the Service, within the scope of use of the Service. For paid content, such license is granted upon completion of the payment of the usage fee specified by the Company. This is a non-exclusive license that may not be transferred or sublicensed. Any use beyond this scope is strictly prohibited.
The user agrees in advance that, regardless of the reason, if the user loses the right to use the Service, the user will no longer be able to use any content of the Service.
Late Payment Charges
A user who delays payment of any monetary obligation to the Company shall pay late payment charges to the Company at the rate of 14.6% per annum.
User Submissions
The user represents and warrants to the Company that the user has the lawful right to transmit the information contained in the user's submissions and that the user's submissions do not infringe any intellectual property rights (including copyrights, patent rights, utility model rights, trademark rights, design rights, including the right to acquire such rights or to apply for registration thereof, ideas, know-how, etc.; the same applies hereinafter), property rights, or other rights of any third party.
Copyright in the user's submissions remains with the user. The Company does not acquire copyright in user submissions. However, the Company may, free of charge, without time or geographic limit, reproduce, adapt, publicly transmit (including making transmittable) user submissions to the extent necessary for providing, maintaining, improving, or promoting the Service. In such case, the user shall not exercise any moral rights of authorship against the Company or any party that has succeeded to or been licensed rights by the Company.
The user must back up the user's submissions at the user's own responsibility. The Company has no obligation to back up user submissions.
The user must not submit information that falls under any of the following:
- Information that infringes the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of the Company or any third party
- Information that contains personal information identifying the user (except where required by the Company, such as for registration, or otherwise approved by the Company)
- Information containing obscene expressions
- Information aimed at meeting strangers (whether of the opposite or same sex) or at obscene acts
- Information containing expressions that induce, solicit, or encourage suicide or self-harm
- Information related to the sale of drugs or dangerous drugs, or expressions that encourage their inappropriate use
- Information regarding the promotion or advertising of religious activities, religious organizations, political activities, or political organizations
- Information regarding solicitation related to network business
- Information containing wording equivalent to junk mail or spam mail
- Information that may have a harmful influence on minors
- Cruel expressions or other expressions that may cause discomfort to others
- Information containing malicious programs such as computer viruses
- Any other information that the Company deems inappropriate
Display of Advertisements
The Company may display advertisements of the Company or third parties on the Service.
Prohibited Acts
The user shall not engage in any of the following acts when using the Service.
- Acts that violate, or that promote violation of, laws and regulations, court judgments, decisions or orders, or legally binding administrative measures
- Acts related to criminal activity
- Acts that infringe the intellectual property rights of the Company or any third party
- Acts that infringe the portrait rights, privacy, reputation, or other rights or interests of the Company or any third party
- Acts that place an excessive burden on or interfere with the proper operation of the servers or networks of the Company or any third party
- Acts that may interfere with the operation of the Company's services
- Acts of unauthorized access or attempts thereof
- Acts of analyzing the source code of the Service through disassembly, decompilation, reverse engineering, or similar means
- Acts of unauthorized access to systems connected to the Service or unauthorized alteration or deletion of information stored in the Company's facilities
- Acts of reproducing, transmitting, transferring, lending, or modifying the website or software of the Service
- Acts of lending, transferring, or selling accounts or content of the Service to third parties for compensation
- Acts of commercially using information obtained through the Service
- Acts intended to obtain profit related to the Service through methods not intended by the Company
- Acts of promotion, advertising, solicitation, or sales activities on the Service that are not approved by the Company
- Acts of collecting or accumulating personal information about other users
- Acts of using the Service for illegal, fraudulent, or improper purposes
- Acts that cause disadvantage, damage, or discomfort to other users or other third parties of the Service
- Acts of impersonating other users
- Acts of using another user's account
- Acts intended to meet strangers of the opposite sex
- Acts of providing benefit, directly or indirectly, to anti-social forces
- Acts contrary to public order and morals
- Acts of using the Service while walking, driving a vehicle, or in any other situation or manner in which use of the Service is inappropriate
- Any other acts that the Company deems inappropriate
Prohibition of Conversion to Cash
With respect to any content acquired within the Service or any virtual currency thereof, the following transactions are strictly prohibited by any means.
- Sale and purchase
- Any transfer, acquisition, lending, or borrowing in exchange for money or other consideration
- Any other act that the Company determines constitutes conversion to cash
Exclusion of Anti-Social Forces
The user represents, warrants, and pledges that none of the following currently apply or will apply in the future.
- The user (in the case of a corporation or other entity, including its officers) is an organized crime group, an organized crime group member, a person who has not been an organized crime group member for less than five years, an organized crime group quasi-member, an organized crime group-affiliated company, a corporate racketeer, a "social campaign" type extortionist or a special intelligence violence group, or any equivalent thereof (collectively, "Anti-Social Forces")
- If the user is a corporation or other entity, having a relationship in which Anti-Social Forces are recognized as controlling its management
- If the user is a corporation or other entity, having a relationship in which Anti-Social Forces are recognized as substantially involved in its management
- Having a relationship in which Anti-Social Forces are recognized as being utilized, such as by entering into transactions for the purpose of unjustly benefiting oneself or a third party or causing damage to a third party
- Having a relationship in which the user is involved in providing funds, etc. to Anti-Social Forces or otherwise providing them with conveniences
- If the user is a corporation or other entity, having a relationship in which its officers or persons substantially involved in its management have socially condemnable relationships with Anti-Social Forces
The user warrants that the user will not, by itself or through a third party, engage in any of the following acts.
- Acts of violent demand
- Unfair demand exceeding legal responsibility
- Acts of using threatening words and conduct or violence in connection with transactions
- Acts of damaging the credit of the Company or interfering with the Company's business by spreading rumors, by deceit, or by force
- Any other acts equivalent to the above
Restriction of Use
The Company may, without prior notice, restrict the user's use of all or part of the Service or cancel the user's registration if the user falls under any of the following. The Company is not liable for any damage caused to the user by acts of the Company under this Article.
- If the user violates any provision of these Terms
- If it is found that there is a false fact in the registered information
- If the user defaults on a monetary obligation
- If there is no response from the user to communications from the Company for a reasonable period
- If the user has not used the Service for a reasonable period since the last use
- If the Company determines that the user is an Anti-Social Force or has any interaction or involvement with Anti-Social Forces
- Any other case in which the Company determines that the use of the Service is inappropriate
Suspension of Provision of the Service
The Company may, without prior notice to users, suspend or interrupt the provision of all or part of the Service if it determines that any of the following applies. The Company is not liable for any disadvantage or damage incurred by the user or any third party in such cases.
- When carrying out maintenance, inspection, or updating of the computer systems related to the Service
- When provision of the Service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, natural disaster, or the spread of a virus
- When computers or communication lines are stopped due to an accident
- Any other case in which the Company determines that provision of the Service is difficult
Withdrawal
The user may cancel registration and withdraw from the Service in accordance with the procedures specified by the Company.
Disclaimer of Warranty
The Company does not warrant that the Service or any content provided by the Service is free from system bugs or infringement of third-party rights. The Company also does not warrant the safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose of the Service.
Limitation of Liability
The Company is not liable for any damage incurred by the user in connection with the Service. However, if the contract between the Company and the user concerning the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act, this exemption shall not apply.
Even if the contract constitutes a consumer contract, the Company is liable only for damages directly and actually incurred by the user due to the Company's negligence (excluding gross negligence), and the amount of compensation is limited to the lesser of one month's worth of the most recent usage fee for the Service or JPY 10,000.
Changes to the Service
The Company may, without notifying users, change the contents of the Service or suspend or terminate the provision of the Service. The user agrees in advance, without objection, that if the Service is terminated, the user will lose any right to use paid content and will not be able to use such paid content thereafter. The Company is not liable for any damage caused to users as a result of the foregoing.
Changes to these Terms
The Company may change these Terms at any time without notifying users. The amended Terms become effective from the time they are posted on the Company's website. Users who continue to use the Service after such changes are deemed to have agreed to the amended Terms.
Handling of Personal Information
Personal information of users obtained through the use of the Service will be handled appropriately in accordance with the Company's Privacy Policy.
Notices and Communications
Notices and communications between the user and the Company shall be made in the manner specified by the Company. Unless the user has notified a change in accordance with the procedures separately specified by the Company, the Company may treat the currently registered contact information as valid and send notices or communications to such contact information, which are deemed to have reached the user at the time of transmission.
Assignment of Rights and Obligations
The user may not, without the prior written consent of the Company, assign or pledge as security its position under the user agreement or any rights or obligations under these Terms to any third party.
Business Transfer
If the Company transfers the business related to the Service to another company (including any business transfer, company split, or other case in which the business is transferred), it may assign to the transferee its position under the user agreement, the rights and obligations under these Terms, and the user information together with the business transfer. The user is deemed to have agreed in advance to such assignment.
Application
These Terms apply to all relationships between the user and the Company concerning the use of the Service.
In addition to these Terms, the Company may establish rules for use of the Service. Such rules, regardless of their name, constitute part of these Terms. If these Terms conflict with such rules, those rules shall apply preferentially.
Severability
Even if any provision of these Terms or part thereof is held invalid or unenforceable, such determination shall not affect the other parts, and the remaining parts of these Terms shall continue to be valid and enforceable.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan.
In the event of any dispute concerning the Service, the district court having jurisdiction over the location of the Company's head office shall be the exclusive court of agreed jurisdiction.
